The purpose for the Project is the completion of modernization of divorce law that the state legislature started in 1972 with “no-fault” divorce. Before 1972, if a wife could prove that her husband caused the divorce, she would be awarded more property and money than husband. Also the children, without question. Likewise, if the husband proved the wife was the responsible person, he was awarded more property and more money. And maybe the children.
When the fault of either party was made irrelevant, there was no need for an adversary system.
The need for this Project is to be found in every family law court room in this state.
